Before an insurance company offers a settlement to anyone involved in a car accident, it is quite natural that they will want to hear from as many people involved as possible. This means that the company representing the driver determined to be at fault may attempt to contact you (the victim) in order to hear your side of the story. Should you talk to them? The answer is not as easy to determine as you might think. In general, it is not a wise to talk to the faulty driver’s insurance company. Let us explain some of the reasons why below.
They Do Not Represent You
You will want to remain mindful of the fact that insurance companies represent themselves. They do not have your best interests at heart, particularly when considering the company that represents the guilty party in an accident. As such, they will engage in all sorts of legal maneuvers to try to keep the eventual settlement offered to you as low as possible. This includes using any statements you make to them against you. They will work hard to make you think that they are doing everything they can to help you, when in reality they are trying to help themselves. Because you have a lot on your mind following an accident, it is best to refer any questions from the other insurance company directly to a lawyer that you pick to represent you.
It is important to know that you are under no legal obligation whatsoever to talk to or provide a statement of any kind to the insurance company representing the at-fault driver in a car accident. Because of this, it is usually best to say nothing. You may feel that you have nothing to hide, and that is definitely the case. You are, after all, not at fault. At the same time, insurance adjusters are well trained in their trade. What might seem to be an entirely innocent question might actually be designed to get you to say something that will hurt your case in the end.
You do want to be careful because even the best of memories tend to fade as time goes by. If you give the police statement and then you talk to the insurance adjuster a week later and give him even one piece of information that is different from what you previously stated, an issue could arise. You might also become confused by the questions that are asked of you, and the insurance adjuster may try to use that confusion to justify them not paying out for your medical expenses, time off work, and more.
Avoid Liability Issues
It is a sad reality that people and insurance companies will look for any way to get out of taking on the responsibility that they face in causing an accident. This includes denying you payment for medical expenses, care repairs, and more that you are legally entitled to. In fact, you could argue that the job of the other party’s insurance company is to get away with paying you as little as possible for the accident. Again, always be mindful that you were not at fault here. Do not say anything that could remotely be construed in the wrong way. In fact, avoid speaking to the other insurance company at all. You are not obligated to do so, and you will be better off as a result.
